Appointing a customs broker with power to appoint a sub-agent

I do hereby appoint Border Buddy Technologies Inc. o/a BorderBuddy Customs Brokers, located at 19162 22 Ave Suite 105, Surrey, BC V3S 3S6, as my true, authorized and lawful attorney and agent to transact business on my behalf in all matters relating to customs, excise and tax under the Customs Act and the Excise Tax Act, and shipping and storage related to any contract. This includes all matters relating to the account for and payment and refund of customs and/or excise duties, excise tax, sales tax, and goods and services tax in respect of imported goods released or to be released under such legislation, at the customs offices located in any and all ports in Canada.

In connection with this, BorderBuddy Customs Brokers is authorized to:

  • Execute, sign, and endorse all necessary documents for transactions on my behalf
  • Receive payments due to me and claim rebates, refunds, and remissions from the Canada Border Services Agency
  • Appoint sub-agents in its discretion and deposit payments from the Government of Canada to its account.

I acknowledge that any duties, charges, or other amounts paid by BorderBuddy Customs Brokers on my behalf will be a debt due by me to BorderBuddy Customs Brokers or its sub-agent and any refund, rebate, or remission of such duties, charges, or other amounts will be the property of BorderBuddy Customs Brokers or its sub-agent.

I grant a security interest to BorderBuddy Customs Brokers over all such refunds, rebates, or remissions of duties, charges, or other amounts and over all of my present and after-acquired personal property. I waive my right to receive a copy of any financing statement or verification statement related to this agreement.

I agree to pay all sums owed to BorderBuddy Customs Brokers immediately upon an invoice being issued and all sums remaining unpaid for 15 days from any invoice date will bear interest at the rate of 1.5% per month. I certify that all information provided to BorderBuddy Customs Brokers in connection with this agreement will be true, accurate, and complete.

This agreement is governed by the Standard Trading Conditions of The Canadian Society of Customs Brokers, which have been read and are incorporated into this agreement. This Power of Attorney shall remain in full force until revoked in writing by registered mail. This agreement may be executed in counterparts and may be transmitted by original or facsimile copies, which when taken together, shall be deemed to form one binding agreement and Power of Attorney.
